Job Loss Insurance in India: ESIC Benefit and Private Cover

Job loss insurance in India is not a standalone policy you can buy on its own. The private covers we checked are sold as a section inside a loan or accident-linked general insurance policy, usually pay a few loan EMIs, and exclude resignation, probation and performance-related exits. For employees covered by ESI, the more useful safety net is ESIC's unemployment benefit under the Atal Beemit Vyakti Kalyan Yojana, now extended to 30 June 2027. This guide explains both, from the official scheme page and insurers' policy wordings, and what your employer must pay you when you lose your job.

ESIC Unemployment Benefit: Atal Beemit Vyakti Kalyan Yojana

The Atal Beemit Vyakti Kalyan Yojana (ABVKY) pays cash relief to an insured person who becomes unemployed. It started on 1 July 2018 as a pilot and has been extended several times. At its 198th meeting on 30 June 2026, the ESI Corporation extended it from 1 July 2026 to 30 June 2027.

Eligibility

ESIC's scheme page lists these conditions:

  • You are an employee covered under Section 2(9) of the ESI Act, 1948, that is, an insured person.
  • You were in insurable employment for at least one year immediately before becoming unemployed.
  • You contributed for at least 78 days in the completed contribution period in the 12 months immediately before unemployment.

ESI applies where wages are ₹21,000 a month or less (₹25,000 for employees with disabilities). If your pay is above this, you are not an insured person and this scheme does not apply to you.

How Much You Get

  • Rate: 50% of your average daily earnings (raised from the original 25%).
  • Period: up to 90 days, once in a lifetime.
  • When it is due: 30 days after the date of unemployment.

Example: if your average daily earnings were ₹600, the relief is ₹300 a day. For the full 90 days that is ₹300 × 90 = ₹27,000.

How to Claim

  1. Wait 30 days from the date you became unemployed.
  2. Apply online on the ESIC portal, or submit the claim directly to the designated ESIC Branch Office or Dispensary-cum-Branch Office (DCBO) by post or in person. The claim does not have to go through your employer.
  3. With a physical claim, attach the affidavit, a photocopy of your Aadhaar and your bank account details.
  4. The relief is paid to your bank account after ESIC verifies the claim.

How Private Job Loss Insurance Works in India

The job loss covers we found are sold by general insurers. In the policy wordings we checked, it is one section of a wider policy, with strict triggers and a short payout. Here is what three published wordings say.

Policy (insurer)What triggers a claimWhat it paysKey conditions
Loan Insurance Policy (Retail), Section III Loss of Job (SBI General), UIN SBIPAIP11006V011011Termination, dismissal, temporary suspension or retrenchment by the employer during the policy periodUp to 3 EMIs falling due after the event, until you are re-employed, within the sum insured and after the deductibleSalaried only; no cover in the first 90 days of the policy; unemployment must last at least 30 consecutive days; the section ends after one admitted claim
Sarv Suraksha, Section 4 Loss of Job (HDFC ERGO)Retrenchment because of a merger or acquisitionUp to 3 loan EMIs, or fewer if you are re-employed earlierSalaried only; no cover for job loss for any other reason or for disciplinary action
Income Protect, Benefit 1 (ICICI Lombard), UIN ICIHLGP22084V042122Involuntary job loss caused by an illness or accident-related injury during the coverA fixed monthly amount shown in the policy certificate, for each 30 days of unemployment after a 30-day deductible, up to the stated number of monthsSalaried, on the employer's direct payroll for at least 6 months before cover starts; 90-day waiting period

Two points stand out. First, a plain layoff is covered only by some wordings: HDFC ERGO's Sarv Suraksha section is limited to merger and acquisition retrenchment, and ICICI Lombard's Income Protect pays only when the job loss is caused by illness or injury. Second, the loan-linked covers pay your EMIs, not your salary, so they help only if you have a loan.

Common Exclusions

Across these wordings, a claim is not paid for:

  • Resignation or voluntary retirement.
  • Dismissal for fraud, dishonesty, poor performance, breaking company rules or disciplinary action.
  • Non-confirmation at the end of probation, or job loss during probation.
  • Contract, casual, temporary or seasonal jobs, or staff not on the employer's direct rolls.
  • Self-employment.
  • Suspension pending an enquiry.
  • Job loss in the waiting period at the start of the policy, or job loss you knew about when you bought it.

Before You Buy

  • Read the loss-of-job section of the policy wording, not the brochure.
  • Check the exact trigger: any retrenchment, only mergers and acquisitions, or only illness or injury.
  • Check what is paid: EMIs or a monthly amount, for how many months, and whether a deductible applies.
  • Check the waiting period and whether the section ends after one claim.
  • Check the claim documents. Keep your termination or retrenchment letter, relieving letter and salary slips.

What Your Employer Must Pay When You Lose Your Job

These amounts come from the labour codes, not from insurance, and are often larger than any insurance payout.

DueRuleCalculate it
Notice or notice payFor retrenchment of a worker: one month's written notice with reasons, or one month's wages in lieu; three months and government permission in establishments with 300 or more workersNotice period calculator
Retrenchment compensation15 days' average pay for every completed year of continuous service, for a "worker" with at least one year of serviceRetrenchment compensation calculator
Worker re-skilling fund15 days' last drawn wages for each retrenched worker, credited within 45 days (Section 83, IR Code)Retrenchment compensation calculator
GratuityWages ÷ 26 × 15 × years of service after 5 years (1 year for a fixed-term employee), up to ₹20 lakh, within 30 daysGratuity calculator
Final wages and leave encashmentWithin 2 working days of the last working day (Section 17(2), Code on Wages)Full and final settlement calculator

Managerial and administrative staff, and supervisors earning above ₹18,000 a month, are not "workers" under the IR Code, so retrenchment compensation and the re-skilling fund do not apply to them. They still get notice as per their contract, gratuity, final wages and leave encashment. Retrenchment compensation is tax-free up to the least of the amount received, the statutory amount and ₹5 lakh under Section 19 of the Income-tax Act, 2025.

If you are laid off rather than retrenched, see the lay-off compensation calculator.

Using Your Provident Fund After Job Loss

EPFO has clarified that a member who is unemployed can withdraw up to 75% of the PF balance immediately, without a waiting period. The remaining 25% can be withdrawn after 12 months of unemployment. If you join a new job, transfer the balance with your UAN instead of withdrawing it, so your service and interest continue.

Is Job Loss Insurance Worth It?

  • If you are covered by ESI: you already have the ABVKY benefit. Note your ESI number and keep your contribution record.
  • If you have a home or personal loan: a loan policy with a loss-of-job section can pay a few EMIs. Read the trigger and exclusions first.
  • If you have no loan: EMI-based covers do not help you. An emergency fund of several months' expenses, plus your employer dues and PF, is the more dependable buffer.

About This Guide

Who This Guide Is For

  • Employees worried about layoffs who want to know what cover actually exists in India.
  • Employees covered by ESI who have lost their job and want to claim the unemployment benefit.
